The Overlooked Detail That Could Derail Your Family’s Future and How to Prevent It

by Melissa Shaw | Aug 11, 2025 | Uncategorized

We would do anything to protect our loved ones, right? Whether it’s making sure they’re safe, providing emotional support, or carefully planning for their future, we want what’s best for them. But there’s one conversation many of us hesitate to have about estate planning. It’s heavy, it feels uncomfortable, and it forces us to acknowledge the inevitable. Still, it’s one of the most important things we can do to protect those we care about.

As a real estate professional serving families throughout the Portland, OR, Vancouver, WA, and the Mid-Willamette Valley areas, I’ve walked with many clients through the emotional and logistical stress that follows the loss of a loved one. It’s never easy. But if there’s one thing I’ve learned, it’s this: planning ahead with a proper estate plan can make all the difference for the people you leave behind.

Why Estate Planning Is So Important

Estate planning isn’t just for people with complex portfolios. It’s about peace of mind, family harmony, and protecting the legacy you’ve worked so hard to build. Whether you own one home or several investment properties, not having a clear estate plan leaves your family vulnerable to confusion, stress, and unnecessary complication.

I recently supported a client who believed everything was set up properly. They had the conversations, made assumptions that affairs were in order, and felt assured. But after their loved one passed, the reality hit hard.

“It turned out it actually wasn’t [in place] and it has become a huge headache,” I shared in a recent video. “Not only are they dealing with the emotional loss, but they’re dealing with the stress and the time that it takes to work through probate, hire attorneys, and get all of their loved one’s affairs in order to split 16 ways between family and siblings.”

This situation is all too common. And it’s why conversations about estate plans are not just helpful, they’re essential.

What Is an Estate Plan, Really?

An estate plan is more than just a will. It’s a comprehensive set of legal documents that provide instructions for managing your property and assets after you pass or if you become unable to do so yourself. A good estate plan helps you:

  • Determine how your assets will be divided
  • Appoint guardianship for minor children
  • Avoid probate when possible
  • Minimize family disputes
  • Provide clarity and peace for your loved ones

For families with real estate holdings in the Portland, OR, Vancouver, WA, and the Mid-Willamette Valley areas, this step ensures smooth transitions and asset protection.

Who Should Have an Estate Plan?

You don’t need to be wealthy to need an estate plan. If you have a home, have people who depend on you, or value how your legacy is handled it matters.

“It doesn’t matter if you don’t have a lot or if you have a lot,” I remind my clients. “It’s really irrelevant because if you have someone depending on you, it does matter.”

If you’re a homeowner in one of our area’s family-centered neighborhoods or you’re planning for future generations, now is the time to plan. Whether you’re selling your forever home to move closer to grandkids or shifting seasons as an empty nester, having your estate set up properly protects your loved ones and upholds your family values.
